Acceptance of Terms
By accessing or using the Nalify website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use our website or services.
Services
Nalify provides marketing, branding, content creation, advertising, and related consulting services. All services are provided on a best effort basis. While we apply proven strategies and professional expertise, Nalify does not guarantee specific results, including but not limited to leads, sales, revenue growth, or performance metrics. Results depend on multiple factors outside of our control, including market conditions, client participation, budget, and industry competition.
Client Responsibilities
Clients agree to: Provide accurate information, timely access, assets, approvals, and feedback necessary for service delivery. Respond within reasonable timeframes to avoid delays. Ensure that any materials provided do not infringe on third party rights. Nalify is not responsible for delays, underperformance, or missed timelines caused by incomplete information, late approvals, or lack of cooperation from the client.
Payments and Refunds
Payment terms, fees, billing schedules, and refund policies are governed by the specific proposal, agreement, or contract signed between Nalify and the client. Unless explicitly stated in writing, all payments are non refundable. Failure to make payments on time may result in paused or terminated services.
Intellectual Property
Unless otherwise agreed in writing: Final deliverables produced for a client become the client's property upon full payment. Nalify retains full ownership of its internal methods, frameworks, templates, strategies, processes, concepts, and know how. Nalify may showcase completed work in portfolios, case studies, and marketing materials unless the client explicitly requests otherwise in writing.
Use License
Permission is granted to temporarily access the materials on Nalify's website for personal, non commercial viewing only. This license does not allow you to modify, distribute, reproduce, or commercially exploit any website materials without written permission from Nalify.
Limitation of Liability
To the fullest extent permitted by law, Nalify shall not be liable for any indirect, incidental, special, consequential, or economic damages, including loss of data, loss of revenue, or business interruption, arising from the use or inability to use our services, even if advised of the possibility of such damages. Nalify's total liability shall not exceed the amount paid by the client for services rendered.
Revisions and Modifications
Nalify may revise these Terms of Service at any time without prior notice. By continuing to use the website or services after changes are posted, you agree to be bound by the updated terms.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Minnesota, United States. You agree that any disputes shall be subject to the exclusive jurisdiction of the courts located in Minnesota.
